By using the Gocycle Connect App, you agree to our general data and privacy policy which can be found here. By using the GocycleConnect App, you acknowledge that you are a person of at least 18 years old, and are an authorised person as the owner of the Gocycle or authorised by the owner of the Gocycle to configure the Gocycle using the GocycleConnect App. The GocycleConnect App is security controlled by the email address you provide us when registering to use the GocycleConnect App and you acknowledge and confirm that your email is securely controlled such as with a password only known to you. You agree that when using the GocycleConnect App to configure the Gocycle that you will only configure the Gocycle in accordance with local e-bike laws relevant to your region of operation, and if in doubt you will seek out and will understand the local regional laws applicable to e-bikes from your local authority or e-bike dealer. If you ask us or a 3rd party such as a Gocycle dealer to perform service or diagnostics on your Gocycle, you agree to allow us to make changes to the software and data on your Gocycle for example upgrading to the latest version of firmware or changing the configuration to factory defaults or appropriate configurations for either the European region or North American region. You accept and understand that while we do our best to ensure that no loss of data occurs, from time to time and in the course of service and replacement of components, irrecoverable data loss may occur. You agree to fully release, indemnify, and hold harmless us and all of our …..affiliates…..assigns, and to the fullest extent permitted by law from any and all claims, actions, costs, damages, penalties, fines, demands, losses, liabilities and expenses (including attorneys' fees and court costs) arising out of or in connection with your use of the GocycleConnect App. You agree that the obligations in this section will survive any termination of these Terms.
